VOLUNTEER PROGRAMS & PLACEMANTS SERVICES
AGREEMENT
This Volunteer Program & Placements Services Agreement
is a legally binding contract which sets forth all of the
terms and conditions of your agreement with CCSV-Nepal.
As part of Your application process, You are required to
verify and affirm that You have read and thoroughly reviewed
this contract and that You understand, entirely accept and
agree to be bound by all of its terms. All services and
volunteer arrangements provided by CCSV-Nepal are subject
to this contract and your completion of an application and/or
corresponding payment of any fee to CCSV-Nepal confirm your
contractually binding agreement to all of the terms and
conditions of this contract. If you have any questions regarding
this contract, please email CCSV-Nepal and we will be happy
to assist you.
1. FOR VOLUNTEER APPLICANT:
1.1 You hereby certify that the information given
in the Application Form is correct and acknowledges that
any false information may compromise their participation
to the programme.
1.2 You hereby declare that you are in good health
and require no specialized medical attention.
1.3 You hereby declare that you have never been
arrested or convicted with any criminal offences.
1.4 You hereby authorize CCSV-Nepal to Collect and
retain personal information about you in connection with
your application with Us and You agree to provide additional
information about You as requested by CCSV-Nepal. Such information
to be collected and considered by CCSV-Nepal, in reviewing
Your application includes, but is not limited to, references,
employment history, health history and medical information,
driver’s license numbers, current and previous mailing addresses,
criminal background check and family members. You agree,
understand and acknowledge that CCSV-Nepal may use your
personal information in company promotion materials (newsletter)
or share your personal information with the Placement officers,
staff, Volunteer Coordinator, Host Family Similar connections
or entities in connection with possible Program and placement
for you.
1.5 You hereby agree to be open and flexible in
accepting Program and Placement. You have indicated as your
preference and you agree, understand and acknowledge that
CCSV-Nepal has relied upon your agreement to be flexible
in accepting Your Program and Placement. If, prior to your
arrival in Nepal, You are dissatisfied with the Program
and Placement.
1.6 You agree that you are solely responsible for
ensuring that you have and maintain a valid passport that
is acceptable to the immigration authorities of Nepal and
obtains appropriate documentation for entry to Nepal. Which
will remain valid for the duration of the Program Period
and for a period of at least 2 months after the termination
of the Project Period.
1.7 Upon Submission of Your online application form,
you agree to pay a nonrefundable deposit to CCSV- Nepal
in the amount of US$ 50.00, which represents a portion
of your Program Fees. The payment of the deposit to CCSV-
Nepal shall be, in all cases, nonrefundable and non-transferable.
1.8 Inconsideration for CCSV-Nepal’s services in
planning and arranging Your Volunteer program and placement,
you hereby agree to pay to CCSV-Nepal all fees in accordance
with CCSV-Nepal requirements and to submit all the requested
documentation in a timely manner. CCSV-Nepal cannot be held
responsible for any delay or additional cost caused by the
volunteer participant's failure to do so.
1.9 You agree that it shall be Your sole responsibility
to retain and carry with You any and all necessary contact
information, including the address and telephone number
of CCSV-Nepal’s HQ, the contact hotel and the Volunteer
Coordinator so that You may contact them in the event any
needs should arise.
1.10 You hereby agree that you shall provide voluntary
employment services in connection with the Program requested
and directed from time-to-time by the Program staff. You
hereby agree to join Your Program and Placement on the correct
date and to continue work on the Program and Placement throughout
the duration of the Program and Placement Period.
1.11 You agree to respect the rules of the establishment
where you are volunteering and act in a professional manner
at all times. Because of any language or cultural difficulties,
you cannot expect to command the same responsibilities that
you may have had in your own country.
1.12 If you begin your program and decide it is
unsuitable for your volunteering requirements, and for any
reason you leave your training (or volunteering) establishment
early, no fees paid will be refunded, although every effort
will be made by CCSV-Nepal to find a suitable replacement
with the time available. CCSV-Nepal will not be responsible
for any additional traveling cost etc, which may be incurred
in any such move.
1.13 Occasionally due to operational difficulties,
volunteering may require you to carry out other reasonable
duties than those specified on the original volunteering
description.
1.14 You agree that it shall be your sole responsibility
for all travels before, during and after the program. Choosing
to operate any motorized vehicles, obtaining the necessary
license, permission and insurance will be at your responsibility.
1.15 Developing countries obviously have great needs
but very limited resources. As a result, you hereby agree
that Program and Placement in developing countries cannot
and shall not be held to the same standards as similar Program
and Placement in developed nations. You agree that that
You shall not request any Program and Placement in Nepal,
unless You have a thorough understanding of what to expect
as far as accommodations, meals and likely Program challenges.
1.16 Nepal are lands of cultural wonders and One
of those countries in South Asia that cherish and staunchly
protect their traditional cultures, where values, thinking,
dressing, and daily activities are very different from western
culture. It is your responsibility to understand and follow
the local culture, customs and laws during your entire stay
in Nepal. You agree to dress appropriately, respecting the
culture of Nepal and your Host Family.
1.17 You agree to respect the culture and follow
the rules of the Host Family. Host Families in developing
countries (NEPAL) can be very sensitive to cultural differences.
If you would like to bring a friend for a night or brief
visit, you must first get permission from the Host Family.
However, opposite genders are not allowed to stay in a room
together unless you are a married couple or engaged to be
married.
1.18 You agree and acknowledge that You will not
leave any valuable belongings unattended or in any room
without a lock and that CCSV-Nepal will not be responsible,
under any circumstances, for any damaged, lost or stolen
items. And that you agree that its your own responsibility
to clean and tidy your own room, clothes, and personal use
items during the program period and to bring any necessary
accessories needed for personal use during your stay.
1.19 You agree, understand and acknowledge that
you will be solely responsible for arranging and paying
for your own travel, specifically including all airfare
to and from Nepal and local transportation. It is your responsibility
to carry all necessary documents while you travel in Nepal.
You agree that CCSV shall not be responsible for any supporting
documents necessary for your travel needs or other purposes.
You agree that CCSV is not responsible for any airfare or
for any other charges that may result from canceling, changing
or transferring flights or other arrangements which may
result or occur as a result of Your Program and Placement
in Nepal being revised, cancelled, terminated or otherwise
modified due to Force Majored and any event or circumstances
outside CCSV-Nepal’s Control.
1.20 You agree, understand and acknowledge that
you are solely responsible for all of Your personal expenses
during your Program and Placement, which includes but is
not limited to the cost of daily transportation to and from
Your Host Family accommodations and Your Program and Placement
in Nepal
1.21 You are solely responsible for evaluating and
determining the type, extent and levels of any insurance
coverage you may need or desire during Your Program and
Placement in Nepal. Including, without limitation, coverage
for: light work; the cost of cancellation of the Placement
by You; the cost of assistance including repatriation in
the event of accident or illness; legal liability and expenses;
lost baggage; cancelled flights; medical expenses; liability
arising due to personal injury to You or a third party;
and cancellation of your Placement for any other reason
You are also solely responsible for maintaining any necessary
insurance documents with You as may be needed to prove any
insurance coverage available to You.
2. VOLUNTEER PROGRAM & SERVICES PROVIDED BY CCSV-Nepal
2.1 In consideration of your payment of the Program
Fees identified in the contract and the volunteer services
to be provided by you pursuant to this Agreement, CCSV-Nepal
agrees to arrange a volunteer Program and Placement in Nepal.
For, which you shall provide volunteer services during the
duration of the Program and Placement Period. Additional
specific terms of the Program and Placement in Nepal and
the volunteer services to be provided by you are provided
in the Terms and Conditions. CCSV-Nepal l is not obligated
to perform any other services for or on behalf of you other
than those specific services identified in this Section
Unless specifically provided otherwise in this Agreement,
You shall remain solely responsible for paying any and all
costs and expenses related to your participation in any
Program and Placement.
2.2 Upon receipt of your Online application and
deposit, We will send You an information packs which includes
confirmation of Your initial application form and identifying
the details of the deposit that You have paid Us and the
detail information of your program choices, basic Nepali
language, country information etc. and advice for your confirm
program and placement.
2.3 CCSV-Nepal will review and researches Your Program
requests and attempt to reasonably match your personal interests
or preferences with the list of Programs available. As a
result, you are required to be flexible with regard to Programs
and Placements and / or the specific Project that is ultimately
selected and approved.
2.4 If, after your arrival in Nepal, You are dissatisfied
with Your Programs and Placements CCSV-Nepal will work with
you to find A suitable alternative Program for You; however,
the and Placements Officers and the Volunteer Coordinator
t will work with You and try to resolve any difficulties
as quickly as practicable.
2.5 The Volunteer Coordinator or the Guesthouse
Representative will pick you up from the airport in Nepal.
If You timely inform Us of your flight schedule, in writing,
at least two weeks in advance of Your arrival in Nepal.
Unfortunately, travel delays in developing countries like
(Nepal) are a common occurrence. If, due to unforeseen circumstances,
The Volunteer Coordinator or the Guesthouse Representative
fails to arrive within two hours of your scheduled arrival
in Nepal, You should travel to the local contact hotel (or
any nearby hotel) and call the Volunteer Coordinator or
the CCSV-Nepal staff. CCSV-Nepal will reimburse you for
the cost of traveling to the contact hotel (up to a maximum
of USD$10)
2.6 CCSV-Nepal arranges for a Host Family to provide
living accommodations and meals for You during the Program
Period. In terms of accommodations and meals, CCSV-Nepal
assumes no responsibility beyond arranging for the Host
Family to provide such services to you. If you arrive early
or stay after the Project Period. You are solely responsible
for arranging your own accommodations and meals, at your
sole expense, if you wish to arrive earlier than your program
start date please let us know if you wish us to arrange
accommodation for you.
2.7 Accommodations vary among Placements and may
also depend upon local conditions, the specific Placements
or different programs. The accommodations will be basic
to moderate but will vary depending upon the location within
Nepal. Hygienic conditions for bathroom, toilet and related
living facilities are often below western standards and
are very primitive in Nepal. In most cases, the accommodations
provided to You through the Host Family will consist of
a separate bedroom, a shared lounge area, a shared bath
room, and accessible toilets. However, depending on the
exact situation, you may be required to share a bedroom
in the Host Family's home with other Participants.
2.8 If You choose to spend time away from the accommodations
provided during the Programs and Placements Period, such
as on an overnight trip that You organize, You do so at
Your own cost and neither, CCSV-Nepal nor the Host Family
will refund or reimburse You for accommodation costs incurred
by You during time spent away from the Host Family.
2.9 Through the Host Family, You are provided local
foods, two meals per day, including tea for breakfast and
(Khaja) Snack in the afternoon each day during the Program
Period. The Host Family typically serves a family meal for
all to eat and does not serve separate meals for you and/or
each individual Volunteer. In certain circumstances, you
may wish to supplement the provided meals with food purchased
by you, particularly if you prefer a western diet. In such
cases, you may wish to account for this contingency in your
personal finances and budget. Upon request, the Host Family
will also provide boiled water for drinking. The Host Family
does not provide any mineral water, special diets or other
beverage types. If you have a special or unique diet, you
may contact CCSV-Nepal Volunteer Coordinator and request
assistance and the Volunteer Coordinator may attempt to
assist you but neither CCSV-Nepal nor the Host Family has
any obligation to assist you with special dietary needs.
If you require any additional dietary or other supplements
to the meals provided through the Host Family, You must
make such arrangements, as you deem necessary at your own
personal expense. All meals provided during the Program
Period are provided exclusively through the Host Family
so you are solely responsible for all meals while away from
the Host Family. No refund or other reimbursement is available
if you decide to spend time away from the Host Family during
the Program Period.
2.10 We will provide you with the final details
of your program/ Placement not less than 7 days before your
program start date
2.11 Your payment of the US$ 50.00 advance
deposit payment to CCSV-Nepal is strictly non-refundable
and non-transferable under any and all circumstances.
2.12 If you wish to postponed or cancel your participation
in CCSV-Nepal Volunteer Program, your US$50.00 deposit
can still access to any of our CCSV-Nepal program within
one-year period at no extra cost.
2.13 CCSV-Nepal generally does not provide or make other
arrangements for issuance of working visas, particularly
since our programs are strictly for voluntary services only.
This must be tourist visa for maximum 5 months, during this
period volunteers are unable to earn money or take paid
work.
2.14 CCSV-Nepal reserve the right to dismiss from
the programme any Volunteer participant who is deemed to
be a danger to themselves or others or whose conduct is
deemed to be harmful to the programme. In the event of this
case, CCSV-Nepal cannot be held responsible for any costs
incurred by the participant.
2.15 CCSV-Nepal shall not be responsible for or
supposed to be in default by reason of delays in or failure
of performance of this agreement due to causes beyond its
reasonable control and not being limited to civil war, \
upraising, strikes, riots, fires, floods, explosions, earthquakes,
serious accidents, any act of government, governmental priorities,
allocations, regulations, the public enemy, failure of transportation,
epidemics, quarantine restrictions, or labor trouble causing
termination, slowdown or interruption of work and failure
of suppliers to furnish materials, interruption their Volunteering
period.
2.16 The laws of Nepal shall govern this Agreement.
3. RELEASES AND WAIVER OF LIABILITIES
3.1 YOU HEREBY AGREE, UNDERSTAND AND ACKNOWLEDGE
THAT YOUR AGREEMENT TO TRAVEL TO, TEMPORARILY LIVE IN AND
PROVIDE VOLUNTEER SERVICES ON A PROGRAM IN NEPAL NECESSARILY
INVOLVES A CERTAIN DEGREE OF HAZARDS, INHERENTLY DANGEROUS
ACTIVITIES AND PERSONAL RISKS TO YOU, BOTH FORESEEN AND
UNFORESEEN, ALL OF WHICH ARE FULLY ACCEPTED BY AND SOLELY
ASSUMED BY YOU. IN ADDITION, YOU HEREBY FULLY AND PERMANENTLY
RELEASE AND FOREVER DISCHARGE CCSV-NEPAL FROM ANY AND ALL
LIABILITY FOR YOUR PERSONAL INJURY, EMOTIONAL INJURY, ILLNESS,
DISEASE, DEATH, AND/OR PROPERTY DAMAGE THAT MAY RESULT OR
OCCUR DURING YOUR PROGRAM AND/OR THE VOLUNTEERPLACEMENT
PERIOD.
4. RELEASE AND WAIVERS IN FAVOR OF CCSV-NEPAL.
4.1 YOU HEREBY FULLY, PERMANENTLY AND IRREVOCABLY
RELEASE, FOREVER DISCHARGE AND AGREE NOT TO SUE CCSV-NEPAL,
INCLUDING ANY AND ALL OF ITS SUCCESSORS AND ASSIGNS, ITS
MANAGERS, PARTICIPANTS, APPLICANTS, MEMBERS, EMPLOYEES,
OFFICERS OR REPRESENTATIVES, AND ANY COUNTRY COORDINATORS,
VOLUNTEER COORDINATORS, HOST FAMILIES OR OTHER PERSONS,
ENTITIES, PARTIES, ORGANIZATIONS OR AGENCIES COLLABORATING
WITH CCSV-NEPAL (COLLECTIVELY “RELEASED PARTIES”), VOLUNTARILY
AND WITHOUT FORCE, FROM ANY AND ALL ACTIONS, SUITS, LIABILITY,
CLAIMS, DEMANDS, LOSSES, COSTS AND/OR CAUSES OF ACTION FOR
DAMAGES OR OTHER LEGAL OR EQUITABLE RELIEF OF ANY NATURE
INCLUDING, WITHOUT LIMITATION, CLAIMS FOR PERSONAL INJURY,
EMOTIONAL INJURY, ILLNESS, DISEASE, DEATH, PROPERTY DAMAGE
OR OTHER LOSSES, EXPENSES AND/OR DAMAGES (COLLECTIVELY “CLAIMS”),
WHICH MAY HEREAFTER ARISE FROM ANY CAUSE WHATSOEVER, INCLUDING,
WITHOUT LIMITATION, THAT ARISING FROM YOUR PARTICIPATION
IN ANY PROJECT OR PLACEMENT AND/OR ANY PROJECT, ACTIVITY
OR EVENT SPONSORED, MANAGED, ARRANGED, OR PROMOTED BY, OR
OTHERWISE AFFILIATED OR ASSOCIATED WITH CCSV-NEPAL, WHETHER
OR NOT FORESEEABLE OR CONTRIBUTED TO BY THE NEGLIGENT ACTS
OR OMISSIONS OF CCSV-NEPAL OR OTHERS.
